Terms of Service
Subscription, billing, and cancellations for Sonar.
Introduction and Acceptance
These Terms of Service ("Terms") govern your use of Sonar, a bot protection service for Minecraft servers ("Service"), provided by the entity identified in our Imprint ("we", "us", or "our").
By creating an account, subscribing to a plan, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service. These Terms constitute a legally binding agreement between you and us.
Scope: These Terms apply to all users of the Service, whether you are using a free trial, paid subscription, or any other access method. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
1) Account Registration and Security
Registration: To use our Service, you must create an account by providing accurate, current, and complete information. You must keep your account information up to date. You may not use another person's account without permission.
Account Security: You are responsible for maintaining the confidentiality of your account credentials (username and password). You must use a strong password and are encouraged to enable two-factor authentication if available. You are responsible for all activities that occur under your account that result from your failure to maintain the confidentiality of your credentials or from your negligence. However, you are not responsible for unauthorized use that occurs despite your reasonable security precautions.
Unauthorized Access: You must notify us immediately (within 24 hours of discovery) if you become aware of any unauthorized use of your account or any other breach of security. We will investigate such reports and take appropriate action. We are not liable for losses arising from your failure to protect your account credentials or your failure to promptly notify us of unauthorized access.
Account Termination: We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.
2) Subscription Plans and Automatic Renewal
Subscription Model: Sonar is sold as monthly subscriptions ("Plans"). Your billing period starts on the day you subscribe and renews monthly on the same day of each month.
Automatic Renewal: Your subscription will automatically renew at the end of each billing period and you will be charged the then-current subscription fee unless you cancel before the renewal date. By subscribing, you explicitly agree to this automatic renewal. You will receive a reminder email before each renewal.
Cancellation of Auto-Renewal: You can cancel the automatic renewal at any time from your Billing page. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.
3) Pricing, Taxes, and Price Changes
Pricing: Prices are shown before taxes unless stated otherwise. Applicable taxes (such as VAT, sales tax, or other local taxes) may be added at checkout depending on your billing address and local laws. All prices are in the currency displayed on the pricing page.
Price Changes: We reserve the right to change our subscription prices. If we increase prices, we will notify you at least 30 days before the change takes effect. The new price will apply from your next renewal date after the notice period. You have the right to cancel your subscription before the new price takes effect if you do not agree to the price increase. If you do not cancel, your continued use of the Service after the price change constitutes acceptance of the new price.
Special Right of Termination: For EU consumers, if we increase prices by more than 5% within a 12-month period, you have a special right to terminate your subscription with immediate effect within 14 days of receiving the price change notification, and you will receive a pro-rated refund for any unused portion of your subscription.
4) Payments
Payments are processed securely by Stripe. You authorize us (via Stripe) to charge your saved payment method for recurring fees and any prorated amounts. If a payment fails, Stripe will retry; we may suspend service until payment succeeds.
5) Payment Failures and Grace Period
If a payment fails (for example, due to an expired or declined credit card), the following policy applies:
- Grace Period (7 days): You will receive a grace period of 7 days from the first failed payment attempt. During this time, you retain full access to all features and your servers remain active. We will notify you via email and display a warning in the dashboard.
- After Grace Period: If payment has not been received after 7 days, your servers will be automatically deactivated according to your plan limits. You will still have read-only access to view your data and statistics.
- Data Retention: Your data will be retained for 30 days after the initial payment failure. After this period, your data may be permanently deleted.
- Reactivation: Once you update your payment method and payment is successfully processed, your servers will be immediately reactivated and full access restored.
Stripe will automatically retry failed payments according to their retry schedule. You can update your payment method at any time from the Billing page.
6) Plan Changes
- Immediate change (typically upgrades): takes effect now. We apply proration (charge or credit) for the remainder of the current billing period.
- Change at period end (typically downgrades): takes effect at the end of your current billing period. No proration is charged or refunded on the day you schedule the change.
We do not create duplicate subscriptions for plan changes; we modify your existing subscription.
7) Cancellation
You can cancel at any time from the Billing page. When you cancel, your subscription remains active until the end of the current billing period. You will not be billed again after that. You can reactivate any time before the period ends to maintain continuous service.
8) Refunds and Service Credits
General Policy: We generally do not provide refunds for partial months or unused time after the withdrawal period has expired. Subscriptions are billed in advance for the full billing period, and cancellation does not entitle you to a refund for the remainder of that period.
Exceptions: We will provide refunds or service credits in the following cases: (a) if we terminate your account without cause; (b) if there is a material service outage or defect that we cannot resolve within a reasonable time; (c) if you exercise your right of withdrawal within 14 days (see Section 9); (d) if a charge was made in error; (e) as required by applicable law.
Refund Process: To request a refund, contact our support team with details of your request. We will investigate and respond within 14 days. Approved refunds will be processed to your original payment method within 14 days of approval.
Consumer Rights: Nothing in this section limits your statutory rights as a consumer under applicable law, including your rights in case of defective services or non-performance.
9) Right of Withdrawal (EU Consumers)
For consumers in the European Union: You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the day of contract conclusion (subscription start). To exercise your right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement (e.g., email to the contact address provided in our Imprint).
Early termination of withdrawal right: If you request that the performance of services begin during the withdrawal period, you acknowledge that you lose your right of withdrawal once the service has been fully performed. By subscribing and immediately using our service, you expressly request immediate performance and acknowledge the loss of your withdrawal right.
Consequences of withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Model withdrawal form: You can use the following form, but it is not obligatory:
"I hereby give notice that I withdraw from my contract for the provision of the following service: Sonar Subscription, ordered on [date], email address: [your email]"
10) Fair Use and Acceptable Use Policy
Service Limits: You agree not to misuse the Service or attempt to bypass technical limits. We may enforce plan limits (for example, server count) based on your current plan. Excessive use that impacts service performance for other users may result in throttling or suspension.
Intended Purpose: Sonar is provided solely for the purpose of bot protection on Minecraft servers. You may not use the Service for any illegal purpose or in violation of any laws. Testing the software or providing a testing environment for illegal activities, such as botting, DDoS attacks, or any form of unauthorized access, is strictly forbidden.
Prohibited Activities: You must not: (a) reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying components of the Service; (b) modify, adapt, or create derivative works from the Service; (c) tamper with, bypass, or alter any security or technical measures; (d) attempt to gain unauthorized access to our systems or networks; (e) use the Service to transmit malware, viruses, or harmful code; (f) interfere with or disrupt the Service or servers; (g) violate any applicable laws or regulations.
11) Intellectual Property and License
Ownership: The Service, including all software, code, designs, graphics, text, and other content (collectively, "Content"), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by us.
Limited License: Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your internal business purposes in accordance with these Terms and your subscription plan.
Your Content: You retain all rights to any data, configurations, or content you submit to the Service ("Your Content"). By submitting Your Content, you grant us a limited license to use, store, and process Your Content solely to provide the Service to you. We will not share Your Content with third parties except as necessary to provide the Service or as required by law.
Feedback: If you provide us with any suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such Feedback into our Service without any obligation to you.
12) Service Availability and Changes
We aim for high availability but do not guarantee uninterrupted service. We may update features, interfaces, and documentation from time to time. We may change these Terms; if changes are material, we will notify you. Continued use after notice means you accept the changes.
13) Data Protection and Privacy
We handle your personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) where applicable. For detailed information about how we collect, use, and protect your data, please see our Privacy Policy.
Payment Processing: Payment data is processed securely by Stripe, Inc. (USA), our payment service provider. We do not store full credit card numbers. Stripe is certified under the EU-U.S. Data Privacy Framework. For more information, see Stripe's privacy policy at stripe.com/privacy.
Your Rights: Under GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. You also have the right to lodge a complaint with a supervisory authority. To exercise these rights, please contact us using the details in our Imprint.
Data Retention: We retain your data as long as necessary to provide our services and comply with legal obligations. After account deletion or subscription termination, we may retain certain data for up to 30 days for backup and recovery purposes, and longer where required by law (e.g., tax records).
14) Termination by Us
We may suspend or terminate your account for violations of these Terms or for unlawful use. If we terminate without cause, we will provide a pro-rated credit for the remaining paid period.
15) Warranties, Disclaimers, and Limitation of Liability
Service Performance: You acknowledge that the Service relies on detection mechanisms and algorithms that are not infallible. While we strive to provide accurate bot detection, we do not guarantee that all bots will be detected or that there will be no false positives. The effectiveness of the Service depends on various factors, some of which are outside our control.
Disclaimer (to the extent permitted by law): The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability (Business Users): For business users (non-consumers), to the extent permitted by law, our total liability for any claims arising out of or related to these Terms or the Service is limited to the fees paid by you for the Service in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
Consumer Rights (EU/EEA): If you are a consumer in the EU/EEA, nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law. For consumers, our liability for defects in the Service is governed by applicable consumer protection laws.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
16) Contact
For billing and support, use the Support link in the app or the contact email on your invoices.
17) Software Updates
Sonar reserves the right to modify or update its software at any time, without prior notice, to improve its performance, security, or to add new features. The user acknowledges that these updates may affect the software's compatibility with their server environment or third-party software and that it is their responsibility to ensure continued compatibility.
18) User Conduct
The use of Sonar to harass, defame, or discriminate against any individual or group is prohibited. We reserve the right to terminate your license for any such behavior.
19) Governing Law and Jurisdiction
⚠️ TODO: Specify your jurisdiction! These Terms are governed by the laws of [YOUR COUNTRY/STATE], without regard to its conflict of law provisions.
For EU Consumers: If you are a consumer habitually resident in the EU, you additionally enjoy the protection of mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
Contract Language: These Terms are provided in English. If we provide a translation, the English version prevails in case of any conflict or discrepancy.
20) Dispute Resolution and Alternative Dispute Resolution
Online Dispute Resolution (EU): The European Commission provides a platform for online dispute resolution (ODR) which can be found at https://ec.europa.eu/consumers/odr. Our email address is provided in our Imprint.
Consumer Arbitration (Germany - VSBG): We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). This does not affect your right to take legal action.
Amicable Resolution: Despite not being required to participate in formal arbitration, we are committed to resolving disputes amicably where possible. If you have any concerns or disputes regarding these Terms or our Service, please contact us first using the contact information in our Imprint. We will make every effort to resolve the issue directly with you.
21) IP Restrictions
We reserve the right to block IP addresses from connecting to our infrastructure. This action would render Sonar inoperative. This restriction applies to IP addresses originating from sanctioned countries, those found in spam databases, or those involved in misuse, as well as any IP addresses that are not associated with a valid license or plan.
22) Changes to Our Terms
We may update these Terms of Service at any time to reflect changes in our service or business practices. We'll do our best to notify you of any material changes. The "Last updated" date at the top of this page will always show when the most recent changes were made. Your continued use of Sonar after any changes take effect means you accept and agree to the new Terms of Service.
23) Severability and Entire Agreement
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, which shall remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Service.
No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
Assignment: You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you. Any attempted assignment in violation of this section shall be void.
